Welcome to the Viewing Agency (“we,” “our,” or “us”).  These Terms and Conditions govern the use of our property/land viewing agency services, and property condition report services (“Services”).  By using our Services, you agree to these Terms.  If you do not agree, please do not use our Services.


1. Services Provided


We act as a third-party viewing agency, attending property/land viewings on behalf of clients and providing general feedback.  We do not offer property/land advice, valuations, or legal services.  Our Services include:


  • Viewing Service for Vendors and Landlords:   We conduct property/land viewings on behalf of property/land owners, providing general feedback to assist in the selling or renting process. Our feedback does not form the basis of formal advice/opinion.
  • Viewing Service for Purchasers and Tenants:   We attend viewings on behalf of prospective buyers and tenants, providing unbiased general feedback to help inform their choices.  Our feedback does not form the basis of formal advice/opinion. 
  • Property Condition Reports:   We assess and document the condition of properties using the standard condition report form as provided by Jersey Government.  It is the landlord’s responsibility to ensure they have booked us to undertake the  condition report within the 7-day timeframe of the tenant agreeing to live  in the property.   Our deadline for undertaking the report is day 5 of this time period, which must be a working week day (Monday to Friday) so that we have time to complete the report and send it by email to the landlord prior to the 7-day deadline. Once the report is undertaken by us, we will send it to the landlord  by email, it is then the landlord’s responsibility to review the  information on the report for accuracy, fill in any missing information  and complete the remaining legal process of the report requirements with  their tenant.


2. How the Service Works


  • Individual, Open House, or Virtual Viewings: 


We offer tailored viewing Services for vendors, landlords, purchasers, and tenants, including those off-island seeking buy-to-let properties. We conduct individual, open house, and virtual viewings for residential and commercial properties/land.


  • Viewing Service for Vendors and Landlords: 


1. If you are selling or renting a property/land, we provide a free consultation during which we will meet with you at the said property/land to find out the key benefits and essential details that buyers and tenants will need to know. During this time, we will also collect a spare set of keys or be provided with a key safe code so that we can facilitate seamless viewings. Vendors and landlords must provide us with accurate property details and specifications in writing that can be passed onto those viewing your property/land.


2. Once someone contacts you to arrange a viewing of your residential/commercial property/land, please contact us with your preferred days and times for viewings during that week and ask your prospective buyer/tenant to contact us directly via email together with their name and telephone number to arrange the viewing.


3. Upon a date and time for the viewing being agreed in writing by email between us and your prospective buyer/tenant, we will require payment in full from you via bacs on the day the ‘booking’ for the viewing has been agreed in writing (not the day of the viewing). Viewing bookings will only be secured within a minimum of 48 hours prior to the viewing to allow for your payment to be made and cleared prior to the viewing.  We reserve the right not to undertake your viewing if payment has not cleared prior to the day and time booked for the viewing to be undertaken.


4. After the viewing has been undertaken, we will provide you with general feedback in writing by email as given by the prospective buyer/tenant (if they choose to provide feedback).


5. Upon completion of the viewing and if you no longer require us for any future viewings within the next 4 weeks, we will return any keys provided free of charge within the next 5 working days of the last viewing being undertaken.


6. For our Cancellations, Rescheduling & Refund Conditions in relation to viewings, please refer to part 6 below.


  • Viewing Service for Purchasers and Tenants:


1. If you are looking to purchase or rent a property in Jersey, and whether you live locally, or in the UK/beyond, we will undertake a complementary video call to understand your requirements.


2. Following our telephone call, once you have found some properties you would like us to view on your behalf, simply send us the links to the properties and we will arrange the viewing time.


3. Upon a date and time for the viewing being agreed in writing by email between us and the vendor/landlord of the property/land (including any of their agents), we will require payment in full from you via bacs on the day the ‘booking’ for the viewing has been agreed in writing (not the day of the viewing). Viewing bookings will only be secured within a minimum of 48 hours prior to the viewing to allow for your payment to be made and cleared prior to the viewing.  We reserve the right not to undertake your viewing if payment has not cleared prior to the day and time booked for the viewing to be undertaken.


4. The viewing will be carried out for you either via video call if you are available at the same time, or recorded video, and/or photographs. We will also provide you with a brief written summary of the property following the viewing.


5. For our Cancellations, Rescheduling & Refund Conditions in relation to viewings, please refer to part 6 below.


  • Property Condition Reports:


1. If you would like us to assist with a property condition report at the beginning of a tenancy, please contact us on the same day that the tenant has agreed to live in the property to book us to undertake the report. Due to the short legal timescale to be able to undertake a property condition report, we cannot always guarantee our availability but will endeavour to assist you prior to or by day 5 of the 7 day deadline for undertaking a condition report. Please note we only undertake property condition reports during Monday to Friday.


2. Once you have agreed a date and time with us in writing by email to complete the condition report, we will require payment in full from you via bacs on the day the ‘booking’ for the condition report has been agreed in writing (not the day of the report being undertaken). Property condition report bookings will only be secured within a minimum of 48 hours prior to the day that the condition report is to be undertaken, to allow for your payment to be made and cleared prior to the day of the report. We reserve the right not to undertake your condition report if payment has not cleared prior to the day and time booked for the condition report to be undertaken.


3. Upon booking us for a property condition report, we will also need to arrange a time with you to collect the keys to the property or be provided with a key safe code/otherwise. This must be prior to the date that the condition report is booked to be undertaken.


4. Once the report is completed, we will send it by email to you (the landlord) prior to the 7-day deadline. It is your responsibility to review the information on the report for accuracy, fill in any missing information and complete the remaining legal process of the report requirements with your tenant.


5. Upon the completion of the property condition report, we will return any keys provided free of charge within the next 5 working days.


6. For our Cancellations, Rescheduling & Refund Conditions in relation to property condition reports, please refer to part 6 below.


3. Insurance 


  • Our viewing service is insured for public liability up to the value of £2,000,000, insuring any third-party property damage caused up to this value. Our insurance also covers for the cost of replacing locks, keys and electronic pass cards if they are lost.
  • We are not insured for any third-party theft. Please ensure you have contents insurance for your property in the event of theft by a third-party. It is your responsibility to make sure your contents insurance will cover you in the event of a third-party theft during the course of the provision of our Services.  Whilst we will carry out our Services with diligence, if you book any of our Services without having appropriate insurance cover for your property contents during the course of our Services, we will not be responsible for any third-party theft of fixtures/fittings/items, whether of high value or otherwise, and whether located inside or outside of your property.
  • If you do not think our insurance cover is adequate to conduct our Services for you, please do not book any of our Services. Please contact us to let us know so that we may have the opportunity to extend our cover to accommodate you prior to booking our Services.


4. Fees


Viewings on behalf of Vendors and Landlords


  • Individual  Viewings: 
    • 30  Mins Individual Viewing: £48 – Apartments and Properties up to 5 bedrooms
    • Up to 1.5 Hours for Large Properties over 5 bedrooms: £78


  • Open  Viewings: 
    • 50  Mins Open Viewing: £58 – Apartments and Properties up to 5 bedrooms
    • 1.5  Hours Open Viewing: £78 – Large Properties over 5 bedrooms


Viewings for Purchasers and Tenants


  • Viewings: 
    • 30  Mins Viewing (Individual or Open Viewing): £48 – Apartments and Properties up to 5 bedrooms
    • Up to 1.5 Hours for Large Properties (Individual or Open Viewing): £78


Property Condition Reports:


  • Apartments  and Properties up to 3 bedrooms: £65
  • Properties with 4-5 bedrooms: £85
  • Large  properties and estates: Please contact for a personalised quote


5. Payments


  • Payments must be made in full by bacs in GBP at the time of ‘booking’ as confirmed in writing by email as per the terms above for each service.


6. Cancellations, Rescheduling & Refund Conditions


Viewing Service for Vendors and Landlords:


  • Once a booking has been made for any of our Services and your payment has cleared with us, we do not provide any refunds for our Services.  We do not provide refunds for any  cancellations on your behalf for any reason.
  • Services booked and therefore paid for, may be re-scheduled only upon the following conditions:


- The Vendor or Landlord must provide 24 hours’ notice prior to the time of the booked viewing to see if it is possible to reschedule the viewing date/time with the person booked to view the property. The re-scheduled viewing must take place within the next 7 working days from the date of the booked viewing. Failure to provide this notice by you and failure to be able to re-schedule the viewing within the next 7 working days will still result in forfeiture of a refund. If you or the person(s) viewing your property are not able to re-schedule the booked viewing within the next 7 working days from the date of the booked viewing, a completely new booking will need to be made.


Viewing Service for Purchasers and Tenants:


  • Once a booking has been made for any of our Services  and your payment has cleared with us, we do not provide any refunds for our Services.  We do not provide refunds for any cancellations on your behalf for any reason.
  • Services booked and therefore paid for, may be re-scheduled only upon the following conditions:


- If the Purchaser or Tenant wishes to re-schedule the booked viewing, they must provide us with 24 hours’ notice prior to the time of the booked viewing to see if it is possible to reschedule the viewing date/time with the owner of the property/land or their agent(s). The re-scheduled viewing must take place within the next 7 working days from the date of the booked viewing.  Failure to provide this notice by you and failure to be able to re-schedule the viewing within the next 7 working days will still result in forfeiture of a refund.  If you or the owner of the property/land or their agent(s) are not able to re-schedule the booked viewing within the next 7 working days from the date of the booked viewing, a completely new booking will need to be made.

- If the owner of the property/land or their agent(s) needs to re-schedule the booked viewing this is out of our control and we are happy to re-schedule the viewing on you behalf providing it is within the next 7 working days of the original booked viewing and agreed by all parties. If you or the owner of the property/land or their agent(s) are not able to re-schedule the booked viewing within the next 7 working days from the date of the booked viewing, a completely new booking will need to be made.

- Should a property/land you have made a booking with us to view on your behalf become under offer or taken off the market/otherwise no longer available prior to your booked viewing, we will not issue a refund.


Property Condition Reports:


  • Once  a booking has been made for a property condition report to be undertaken and your payment has cleared with us, we do not provide any refunds for our Services.  We do not provide refunds for any cancellations on your behalf for any reason, at any time.


If We Cancel a Viewing


  • A  full refund will only be issued for our Services if we cancel the viewing due to unforeseen  circumstances such as sickness or an emergency.


7. Limitation of Liability


  • We are not responsible for the accuracy of information provided by property/land  owners or any of their agents regarding the properties/land owned or managed by them in respect of any of our Services.
  • We are not liable for any decisions made by any parties based on our viewing feedback/otherwise and property condition reports.
  • We do not guarantee property availability, pricing, or suitability.


8. Confidentiality


  • Any client and third-party information provided to us will be kept      confidential and used only for the purpose of delivering our Services as      above.
  • We may store written feedback, images, videos, contact/address details and property condition reports for record-keeping purposes only but will not share them without consent.


9. Amendments


We reserve the right to update these Terms and Conditions at any time.  Changes will take effect upon posting on our website.  Continued use of our Services constitutes acceptance of the updated Terms.


10. Governing Law


These Terms are governed by the laws of Jersey, Channel Islands. Any disputes will be resolved in the courts of Jersey, Channel Islands.
